Terms of Use - DaDesktop Public Cloud

Purpose

The remote desktops provided are intended solely for conducting training sessions, consulting engagements, or recruitment activities.

 

Billing

Non-permitted use

The following activities are prohibited:

  1. Hosting websites or other services
  2. Mining cryptocurrencies (e.g., Bitcoin)
  3. Running performance tests

Should DaDesktop personnel detect any such behavior, the service will be immediately revoked with no refund.

 

Guarantee and Service Layer Agreement

DaDesktop commits to a 95% service availability level.

Maintenance work, repairs, and upgrades will be carried out outside the hosted working hours of 8 a.m. to 8 p.m. local time here in Germany (the timezone where the server is physically situated).

 

Data Safety and Confidentiality

The service is provided on an as-is basis; DaDesktop cannot assure the safety or confidentiality of any data stored on the desktops. If this is a requirement, you may want to explore DaDesktop On-Premise as an alternative.

Since these desktops are primarily intended for training, they are not appropriate for handling highly sensitive information.

Authentication to the remote desktops is optimized for ease of use, not security.

Troubleshooting Recording

Course-related desktops (Fresh-start, Trainer, and Participants) may be recorded for diagnostic purposes.

DaDesktop DELIVERS THE SERVICES AS IS, WITH ALL FAULTS AND AS AVAILABLE. WE AND OUR SUPPLIERS OFFER NO EXPRESS OR IMPLIED WARRANTIES OR GUARANTEES REGARDING THE SERVICES. TO THE EXTENT ALLOWED BY LAW, WE AND OUR SUPPLIERS DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE AND OUR SUPPLIERS DO NOT WARRANT THAT THE RESULTS OBTAINED FROM USING THE SERVICES WILL BE EFFECTIVE, RELIABLE, ACCURATE, OR SUITABLE FOR YOUR NEEDS. WE DO NOT GUARANTEE THAT YOU WILL BE ABLE TO ACCESS OR USE THE SERVICES (DIRECTLY OR THROUGH THIRD-PARTY NETWORKS) AT YOUR PREFERRED TIMES OR LOCATIONS. NO VERBAL OR WRITTEN STATEMENTS FROM A DaDesktop REPRESENTATIVE SHALL CREATE ANY WARRANTY. YOU MAY POSSESS ADDITIONAL CONSUMER RIGHTS UNDER LOCAL LAWS THAT THIS AGREEMENT CANNOT ALTER. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.

YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH US OR OUR SUPPLIERS IS THE CANCELLATION OF YOUR ACCOUNT. UNDER NO CIRCUMSTANCES SHALL THE AGGREGATE AND CUMULATIVE LIABILITY OF US, OUR AFFILIATES, AND OUR SUPPLIERS TO YOU FOR ANY AND ALL CLAIMS ARISING FROM THE USE OF THE SERVICES EXCEED THE TOTAL FEES, IF ANY, PAID BY YOU DURING THE PERIOD IN WHICH SUCH CLAIMS AROSE. WE, OUR AFFILIATES, AND OUR SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE.
